2. Definition and General Considerations

For the purposes of these General Terms and Conditions of Use, Boleia.net is an online platform, which allows to know the trips and / or trips of various kinds that its users will carry out, in order to facilitate the sharing (commonly known as "carpooling"). It thus provides individuals who wish to make similar journeys the possibility of knowing each other and arranging such journeys in a joint manner, with the main objective of sharing the inherent costs.

In view of the above, the users of the service provided by Boleia.net portal are not professionals in the field of transport, nor is organized travel any type of professional service. As such, these journeys may not have the quality associated with the professional transport service.

Lindoweb Lda, generator and owner of the platform Boleia.net, does not engage in the activity of transporting people or analogous activity and does not offer any transport service.

3. Acceptance and Alteration of Conditions

The present conditions apply to any use of this site, being certain that, access to it always presupposes the acceptance of these Terms and Conditions of Use.

Partial acceptance of the General Terms and Conditions of Use is not allowed, and its full acceptance is an essential requirement to start using the service.

The Lindoweb Lda team reserves the right, at any time and without prior notice, to delete the member's profile that, after accepting the General Terms and Conditions of Use, disrespects them.

Lindoweb Lda also has the right to change the General Terms and Conditions of Use, at any time, without prior notice, without incurring any liability to its members. It is therefore recommended that the members / users of this portal, website or sub-site promoted by Lindoweb Lda, regularly consult these conditions, in order to keep up-to-date with regard to their knowledge. Members are deemed to accept changes made as of the time they use the site, following publication of those changes.

The user expressly agrees not to try to access this service provided by the platform Boleia.net, in any other way than through the means formally made available by the company for this purpose.

The user of this portal, website or sub-site undertakes to behave in accordance with the general rules of good conduct, the dictates of good faith and good customs, under the terms of the Civil Law at the date in force.

4. Registration on the Portal and Profile Page

After a successful registration - an essential requirement for any individual to become a member / user of the Boleia.net service - each member will have to fill out a page regarding their personal profile. The use of the portal and its services is strictly limited to individuals who have reached the age of majority (18 years of age) at the time of registration. Members agree that all information provided is accurate and complete, and each member is responsible for all statements / information provided. Each user is only allowed to create a profile page, and it is strictly forbidden to create multiple profile pages by the same user. Each member has the right to access and modify his / her personal data at his / her discretion.

After registering and creating a profile page, users will have access to all the services provided by the portal where they registered. All members automatically receive the latest newsletters from Boleia.net in order to be informed of all the news that the service offers, and this option can be given as canceled by the user when updating their preferences in the member profile.

New types of services, costly or free, can be launched on the site at any time, to which members themselves can access.

5. Prohibition of Profit Sharing / Expense Sharing

All members of the site agree to use the service offered by Lindoweb Lda without any commercial or lucrative and non-professional purpose. The use and sharing of the car is done in private, with members traveling together agreeing to share the actual and calculable expenses of the trip. These expenses are related to the costs incurred by an automobile, such as fuel, tolls and car parks, among others. The driver commits himself to calculate these costs, ensuring that the presented value does not include any type of profit to him destined.

All journeys and their parameters, in particular as regards the itinerary and place of collection of passengers, must be organized and agreed between driver and passengers, either through this portal or through another way of contact.

The driver can not charge any of the passengers payment in addition to the due contribution, being strictly forbidden to obtain advantages in monetary terms or any kind of profit through this activity.

The member who, if possible, makes a profit on the journey, is solely and entirely responsible for his actions towards the injured. The Boleia.net platform promotes the conversation between its members in order to agree to share the car without any commercial or lucrative purposes. It is not, as such, liable for breach of any agreement made between driver and passengers or for breach of these General Terms and Conditions of Use, namely, for acting with commercial purpose by a member. Repeat, this mode of action is strictly prohibited and applies to all activities agreed through the online platform. The Boleia.net team reserves the right to inform the competent authorities of any commercial activity, as well as to suspend or even block the access of the offending member to the portal.

6. Contact between members / Rules of travel

The members contact through this portal in order to correct all the details of the trip. As soon as they reach an agreement, the driver undertakes to appear at the agreed place at the scheduled time in order to pick up the passenger(s). It is forbidden for drivers to agree on journeys with a higher number of passengers than the car permits. All passengers undertake to give the driver the amount of the contribution previously agreed to cover travel expenses.

Members are obliged to inform as accurately as possible all the details relating to the journeys they wish to share with other members: place and time of departure, destination, possible stops, places available in the car, value of the contribution to be borne per person, among others.

Driver members undertake to subscribe to and maintain an insurance contract covering the travel and any car sharing offered or marked through this portal, site or sub-site. The driver members also declare that they are holders of a valid driving license, that they are owners of the vehicle in question or that they are authorized to use it, and that the car has a valid periodic inspection certificate, when required.

The driver member is responsible for proving that the insurance he has contracted provides adequate cover for the trip in question, and, if requested by the passengers, must provide the corresponding proof to them.

7. Responsibility

The users of the portal declare that they will not use the service in order to transmit any information of false, threatening, abusive, defamatory or violating the intellectual property rights of a third party; obtain e-mail addresses, with the intention of storing or directing the same unsolicited messages; transmit any information that is subject to secrecy or confidentiality or that only interest third parties; advertising to people, goods or services.

Lindoweb Lda and its partners can not guarantee that each user is effectively at least legally required (age 18) nor accept to be held responsible for the abusive use of any of the services provided or for any undue content or information.

The contents of the portals, websites or sub-sites created and hosted by Lindoweb Lda do not constitute advice, suggestion or obligation, nor do they establish any contractual relationship of liability.

Lindoweb Lda and its partners are not liable for any loss or damage, direct or indirect, suffered by any user, regarding the information contained in this portal, site or sub-site. Likewise, Lindoweb Lda and its partners are not responsible for the accuracy, quality, safety, legality or legality of the contents (ads, ratings, profile data or messages) presented in this portal, site or sub-site, for members or partners, as well as compliance with rules concerning copyright and related rights.

- provision of false or incomplete data by any member;
- cancellation of the trip, last minute changes, no show, or any matter related to the payment / non-payment of the contribution to the expenses by either party (drivers and / or passengers);
- bad behavior, offensive, racist or criminal on the part of a member during a trip.

You understand and agree that Lindoweb Lda and its partners can not be held liable for any direct, indirect, incidental or consequential damages, including, but not limited to, damages due to loss of data, content, or other losses (even if you have been previously advised of the possibility of such damages), resulting from:
- use or impossibility of using the Boleia.net service;
- unauthorized access to personal databases of the service;
- unauthorized modification in the service databases.

Lindoweb Lda reserves the right at any time to modify, suspend, interrupt temporarily or permanently the service provided, with or without prior notice, without this giving rise to any form of compensation for any damages caused to the or to third parties.

For this purpose, the entire partner entity that assists in the dissemination of the Boleia.net service is understood as a partner. This partnership may appear in the form of a "simple" partnership in which the entity is given the possibility of placing a reference to its website in the portal Boleia.net to publicize various activities. Partner will also be the entity for which Lindoweb Lda creates a portal, site or subsite that is directly interconnected to the platform Boleia.net.

8. Intellectual Property Rights

Any reproduction in whole or in part requires the prior written authorization of that company. Boleia.net is a registered trademark owned by Lindoweb Lda, all other trademarks, logos and / or trade names belong to their own owners.

However, only Lindoweb Lda and its partner portals, websites or sub-sites created and hosted by Lindoweb Lda are authorized to use certain member data (such as advertisements and profile data) in order to facilitate the search of travel / travel partners.

If the user is in a different country from the one where the Lindoweb Lda servers are located, communications may result in a transfer of information across borders.

In the case of a criminal investigation conducted by the competent authorities, users acknowledge and agree that all information requested by those same entities shall be provided, in accordance with applicable law.
